1. Acceptance of These Terms

1.1. These Terms of Use ("Terms") govern your access to and use of Trutram.com (the "Platform", "we", "us"), a marketplace for the sale, rental, and advertising of heavy machinery, spare parts, and related services.

1.2. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1.3. These Terms should be read together with our Privacy Policy, Listing Guidelines, and Refund Policy, which form part of your agreement with us.

1.4. We may amend these Terms at any time. Continued use of the Platform after any amendment constitutes your acceptance of the revised Terms.

2. Eligibility and Accounts

2.1. You must be at least 18 years old and have the legal capacity to enter into binding agreements to use the Platform.

2.2. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2.3. You agree to provide accurate and current information when registering and to keep it up to date.

2.4. We reserve the right to suspend or terminate any account that provides false information, violates these Terms, or is used fraudulently.

3. Use of the Platform

3.1. The Platform allows Sellers to publish listings and Buyers to browse, search, and contact Sellers. Rules specific to publishing listings are set out in our Listing Guidelines.

3.2. You agree not to use the Platform to: violate any applicable law; infringe the intellectual property or other rights of any third party; transmit malware, spam, or unsolicited advertising; attempt to gain unauthorized access to the Platform or other users' accounts; or scrape, copy, or redistribute Platform content without our prior written consent.

3.3. We may, at our discretion, restrict, suspend, or terminate access to the Platform for any user who violates these Terms.

4. Trutram.com's Role

4.1. Trutram.com provides a platform that connects Buyers and Sellers. We are not a party to any transaction, agreement, or communication between users, and we do not own, inspect, sell, or rent any of the equipment, parts, or services listed on the Platform.

4.2. We do not guarantee the accuracy, quality, safety, legality, or availability of any listing, nor the identity, reliability, or solvency of any user.

4.3. Any agreement for the sale, rental, or provision of services arising from a listing is strictly between the Buyer and the Seller. You are solely responsible for conducting your own due diligence before entering into any transaction.

5. Fees and Payments

5.1. Certain services on the Platform (such as premium or featured listings) are offered for a fee, as described on our Pricing Plans page at the time of purchase.

5.2. All fees are payable in advance unless stated otherwise. Refunds, where applicable, are governed by our Refund Policy.

5.3. We may change our fees at any time; changes will not affect services already paid for.

6. Intellectual Property

6.1. The Platform's design, logo, software, and other content created by Trutram.com are our property or that of our licensors and are protected by applicable intellectual property laws.

6.2. By submitting content (such as listing text, photographs, or videos), you grant Trutram.com a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content for the purpose of operating and promoting the Platform. You retain ownership of your content and warrant that you have the right to grant this license.

7. Limitation of Liability

7.1. To the fullest extent permitted by applicable law, Trutram.com shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform or any transaction conducted through it.

7.2. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by our negligence.

8. Termination

8.1. You may stop using the Platform and close your account at any time.

8.2. We may suspend or terminate your access to the Platform, with or without notice, if we reasonably believe you have violated these Terms or applicable law.

9. Governing Law

9.1. These Terms are governed by the laws of Portugal, without prejudice to any mandatory consumer-protection rights you may have under the laws of your country of residence within the European Union.

9.2. Any dispute arising from these Terms shall first be addressed through good-faith negotiation; if unresolved, it shall be subject to the jurisdiction of the competent courts of Portugal.
